These terms apply when you use this website, being www.rosecut.co.nz and any other websites we operate with the same domain name and a different extension (“Website”).
These terms also apply when you purchase products through this Website (“Products”).

We separated these terms into three parts, so they are easy to read and understand.

SUBMITTING AN ORDER
By submitting an order for purchase of a Product using the Website’s functionality (Order) you represent and warrant that:
you have the legal capacity and are of sufficient age to enter into a binding contract with us; and
you are authorised to use the debit or credit card you provide with your Order.
Submitting an Order constitutes your intention and offer to enter into Part A of these terms (including Part C which you agreed to by using this Website) where we will provide you with the Products you have ordered in exchange for your payment of the total amount listed upon checkout.
Part A of these terms is not agreed between you and us until we have approved your payment and you receive an email from us confirming that your order is being processed.
ACCOUNTS
To submit an Order and/or to purchase a Product, you may be required to sign-up, register and receive an account through the Website (an Account).
As part of the Account registration process and as part of your continued use of the Website, you may be required to provide personal information and details, such as your email address, first and last name, preferred username, a secure password, billing, postal and physical addresses, mobile phone number, bank account information, and other information as determined by us from time to time.
You warrant that any information you give to us in the course of completing the Account registration process will always be accurate, honest, correct and up-to-date.
Once you complete the Account registration process, we may, in our absolute discretion, choose to accept you as a registered user within the Website and provide you with an Account.
We may suspend or cancel your Account if you do not comply with these terms or any other reason on notice to you.
PRODUCTS
RoseCut offers a range of fine jewellery including natural and lab-grown diamonds, engagement rings, earrings, bracelets, pendants and bespoke pieces. While we take care to ensure our product descriptions, pricing and imagery are accurate, we do not warrant that all information is error-free and reserve the right to correct any inaccuracies at any time without notice. While we strive to accurately represent our products, we cannot guarantee that the product images on our website will exactly match the final item you receive, especially regarding size, width, proportions, and appearance of the diamond. This includes differences in size relative to other elements (e.g., setting or thickness of the ring band) in the image. All images are rendered for the purpose of appeal and marketing.
Product images, digital renderings, and promotional materials shown on our website are intended to illustrate the general appearance, style, and design features of our jewellery, including diamond cut, clarity, and carat weight. These images may depict diamonds in a two-carat setting and are for marketing purposes only. Due to variations in lighting, screen & zoom settings, camera equipment, and rendering software, the actual appearance - including colour, size, and proportions - may differ from what is shown. Such differences do not constitute grounds for return. For accurate details, please refer to the individual product descriptions.
The product images provided on this website are for illustrative purposes only. As diamonds vary in cut, clarity, and carat weight, the actual diamond you receive may differ slightly in appearance from the image. These differences are inherent in the nature of the product, and any variations in the size or appearance of the diamond (based on your chosen carat weight) are not grounds for product returns or disputes.
All Lab-grown Solitaire diamonds will be certified by IGI (International Gemological Institute). All Natural Solitaire diamonds more than 0.30 carats will be certified by GIA (Gemological Institute of America).
All images and visual materials on our website are owned by RoseCut and protected by copyright. Use is permitted only for personal, non-commercial purposes related to evaluating a purchase.
Until the price of your Products is paid in full, title in those Products is retained by RoseCut. Risk in the Products will pass to you on delivery in accordance with clause 6. Delivery must not be refused by you.
All Products are subject to availability. If a Product is unavailable after you place an Order, we will contact you to offer a revised delivery estimate, an alternative Product, or a full refund.
CUSTOM ORDERS AND CONFIRMATIONS
By submitting or confirming a customised or bespoke order (including orders involving personalised design, diamond selection, resizing, engraving, or other modifications), you acknowledge and agree that:
The Product is being made specifically to your specifications;
Production may begin immediately upon confirmation;
Once confirmed, the order cannot be cancelled, changed, refunded, or exchanged once confirmed, except where required by law (such as for defective or faulty goods under the Australian Consumer Law or New Zealand Consumer Guarantees Act).
If you submit a request for a customised or bespoke design through our website, you are entitled to one free 30-minute consultation with our design team. This session allows us to discuss your preferences, clarify design requirements, and provide guidance on diamond and setting options. You may book your consultation via the online booking link provided after submitting your request. Consultations are subject to availability and are conducted via phone or video call, unless otherwise agreed.
PAYMENT
(Pricing): All prices are:
per unit (except where indicated);
in New Zealand Dollars (NZD) or Australian Dollars (AUD), depending on your selected region at checkout; and
subject to change prior to you completing an Order without notice.
(Payment obligations) Unless otherwise agreed in writing, you must pay for all Products at the time of placing an Order.
(GST & duties) For orders shipped to New Zealand, prices are inclusive of 15% GST, custom duties and insured shipping unless otherwise indicated. For orders shipped to Australia, prices are exclusive of GST, duties and any other fees/charges imposed by Australian authorities which are payable by the customer for any clearance at Australian customs. In relation to any GST payable for a taxable supply by RoseCut, you must pay the GST subject to RoseCut providing a tax invoice.
(Card surcharges) RoseCut reserves the right to charge credit card surcharges in the event that payments are made using a credit, debit or charge card (including Visa, MasterCard or American Express).
(Authorisation) By providing your payment details, you authorise us to charge the total amount of your order to the chosen payment method.
(Online payment partner) We may use third-party payment providers such as Stripe, GPay, Apple Pay and AfterPay (Payment Providers) to collect payments for Products. The processing of payments by the Payment Provider will be, in addition to these terms, subject to the terms, conditions and privacy policies of the Payment Providers accessible and, to the maximum extent permitted by law, we will not be liable for the security or performance of the Payment Providers. We reserve the right to correct, or to instruct our Payment Providers to correct, any errors or mistakes in collecting your payment.
(Pricing errors) In the event that we discover an error due to technical glitches or any other reason or inaccuracy in the price at which your order was purchased (including shipping prices), we will attempt to contact you and inform you of this as soon as possible. You will then have the option of purchasing your order at the correct price or cancelling your order. If you choose to cancel your order and payment has already been debited, the full amount will be credited back to your original method of payment.
DELIVERY AND SHIPPING
We are committed to ensuring your order is processed and delivered safely, securely, and in a timely manner. By placing an order with us, you agree to the following shipping and delivery terms:
SHIPPING COSTS
(Shipping costs) Free Standard Shipping is included on all orders within New Zealand and Australia and are calculated upon checkout. All orders are shipped using insured courier services for your peace of mind.
(Processing & Delivery Times):
Standard Processing Time: Orders are typically processed within 4 to 5 weeks from the date of order, excluding public holidays;
Custom or Engraved Items: Processing may take longer. We will provide an estimated delivery timeframe when your order is confirmed;
Estimated Delivery: Once dispatched, orders typically arrive within 20–25 business days. Delivery times are indicative and may vary due to factors outside our control.
(Shipping Methods & Carriers): We use trusted courier partners, such as NZ Post & DHL, to ensure safe and secure delivery. Due to the high value of our products, a signature is required upon delivery.
(Tracking): Once your order is shipped, you will receive an email with tracking details. If you experience any issues with delivery or tracking, please contact us at [email protected]
(Delivery Locations & Restrictions): We currently ship only within New Zealand and Australia. We do not deliver to P.O Boxes or APO/FPO addresses. Please provide a valid physical address at checkout.
(Delivery Delays): While we do our best to meet delivery estimates, RoseCut is not liable for delays caused by: (i) Weather conditions; (ii) Courier delays; (iii) Customs processing; (iv) Natural disasters or unforeseen events. In the event of a significant delay, we will notify you with an updated delivery estimate.
(International Orders): At this time, international orders outside New Zealand and Australia are not accepted. If we approve an international order in special circumstances, you will be responsible for any customs duties, import taxes, and clearance fees. We are not liable for any such charges or delays related to customs.
(Lost or Damaged Packages):
Lost in Transit: If your package is lost, contact us immediately. We will liaise with the carrier to locate your parcel or provide a suitable resolution.
Damaged on Arrival: If your item arrives damaged, contact us within 24 hours of delivery at [email protected] with photos and a description. We will work with you to resolve the issue, which may include a replacement or refund.
(Address Accuracy): Please ensure your shipping address is complete and correct at the time of checkout. We are not responsible for delivery issues arising from incorrect or incomplete addresses. If you need to amend your address, contact us immediately. We will attempt to correct it before dispatch, but cannot guarantee changes once the order is in transit.
(Third-Party Courier Terms): Delivery is handled by third-party couriers, and their terms apply. While we will assist you in resolving any courier issues, we are not responsible for courier service failures beyond our control.
(Policy Updates): We reserve the right to modify this shipping policy at any time. Any updates will be posted on this page and apply to all orders placed after the date of posting.

ORDER CHANGES, CANCELLATIONS & RETURNS
CANCELLATION BY US
We reserve the right to cancel your Order at any time for any reason. If we do, and payment has already been processed, you will receive a full refund to your original payment method.
CANCELLATION BY YOU
You may cancel your Order within 24 hours of placing it by contacting us at [email protected].
A 3% cancellation fee will apply to cover transaction and admin costs.
After 24 hours, cancellations are no longer possible as production will have commenced.
RETURNS AND REFUNDS
Change of Mind: We do not offer returns or refunds for change of mind, especially for bespoke or custom-made Products.
Return Eligibility for Pre-Designed Rings: You may return pre-designed (non-custom) Products within 30 days of dispatch, provided they are:
Unworn and in original, pristine condition; and
Accompanied by all original packaging, tags, and certification.
Returns that do not meet these conditions, or show signs of wear, damage, resizing, or third-party alterations, will not be accepted.
Non-Returnable Items: We do not accept returns on:
Bespoke or custom-made Products;
Products that have been worn, engraved, resized, or altered;
Products repaired or modified by unauthorised third parties
RING RESIZING
(Eligibility for Resizing): Most standard rings are eligible for one complimentary resizing, subject to inspection. Customised, bespoke, or engraved rings are not eligible for resizing unless agreed in writing before purchase. Resizing is typically available within two sizes up or down. Resizing beyond this range sometimes may not be possible and may incur additional charges.
(Resizing Requests): Resizing requests must be made within 30 days of delivery. To request a resize, email [email protected] with your order number and new ring size. Any applicable fees will be confirmed before we proceed.
(Resizing Process & Timeframe): Processing time for resizing is typically 10–15 business days, but may vary depending on ring design and material. Customers are responsible for shipping costs to and from our resizing facility. We recommend using tracked and insured shipping.
(Limitations & Risk): Some designs (such as intricate settings or pavé bands) may not be suitable for resizing. If resizing is not feasible, we will notify you. Resizing is carried out by a third-party jeweller. While all care is taken, RoseCut is not liable for damage to settings, stones, or structural integrity during the resizing process.
(Refunds & Exchanges for Resized Items): Resized rings are not eligible for refund or exchange under our returns policy. If resizing is not possible, no exchange will be offered unless otherwise required under consumer law.
(Customer Responsibility): It is your responsibility to provide the correct ring size. We recommend visiting a local jeweller or using a sizing tool prior to purchase. RoseCut is not responsible for resizing requests based on incorrect size information provided by you.
RETURN PROCESS
Contact Us: Email [email protected] with your order number, tracking details, and reason for return.
Package Securely: Include all original documentation and certificates.
Use Tracked Courier: Ship via a tracked, insured courier. The return cost and risk remain with you.
Inspection: Your return will be assessed by our quality control team (up to 20 business days). If accepted, your refund will be processed within 10–15 business days to your original payment method.
Important: Do not label the package with “diamonds” or any related wording for security reasons.
FAULTY OR DAMAGED ITEMS
If your order arrives damaged or faulty:
Please contact us within 24 hours of delivery at [email protected] with photos and a description of the issue.
If we determine the Product may be faulty, you’ll be asked to return it (including original documentation) for further assessment.
If the Product is confirmed faulty, you’ll be offered a refund, store credit, or replacement, including return shipping costs.
We are not responsible for faults due to:
Wear and tear;
Misuse or mishandling; or
Failure to follow care instructions.
If the fault is not confirmed after assessment, the Product will be returned to you at your expense.
LEGAL RIGHTS
Nothing in these Terms limits your rights under the Australian Consumer Law or the New Zealand Consumer Guarantees Act, including your right to a refund, repair or replacement for faulty goods.
INTELLECTUAL PROPERTY
We retain all intellectual property rights in the design of the Products, including the labelling and packaging, or those rights are owned by a third party. You must not attempt to copy, reproduce, manufacture or otherwise commercialise the Products.
In this clause 7, “intellectual property rights” means all copyright, trade mark, design, patent, semiconductor and circuit layout rights, trade, business, company and domain names, confidential and other proprietary rights, and any other rights to registration of such rights whether created before or after the date of these terms both in New Zealand, Australia and throughout the world.
THIRD PARTY TERMS SUPPLIERS
If we need to acquire goods or services supplied by a third party, you may be subject to the terms and conditions of that third party (Third Party Terms).
Where possible, we will notify you of such Third Party Terms and provide you with a copy of those terms (for example, a link on our Website), you agree to any Third Party Terms applicable to any goods or services supplied by a third party that we use to provide you with the Products or any services related to providing the Products and we will not be liable for any loss or damage suffered by you in connection with such Third Party Terms.

You must only use the Website in accordance with these terms and any applicable laws, and must ensure that your employees, sub-contractors and any other agents who use or access the Website comply with these terms and any applicable laws.

copy, mirror, reproduce, translate, adapt, vary, modify, sell, decipher or decompile any part or aspect of the Website without the express consent of RoseCut;
use the Website for any purpose other than the purposes of browsing, selecting or purchasing Products;

The Website may contain links to other websites that are not our responsibility. We have no control over the content of any linked websites, and we are not responsible for that content.
Inclusion of any linked website on the Website does not imply our approval or endorsement of the linked website.
THIRD PARTY PLATFORM

To the maximum extent permitted by law, RoseCut does not accept responsibility for loss or damage to computer systems, mobile phones or other electronic devices arising in connection with use of the Website. REPORTING MISUSE

Liability And Other Legal Terms
LIABILITIES, WARRANTIES, LEGAL TERMS
CONSUMER LAW PROTECTIONS
Nothing in these Terms limits your rights under the Australian Consumer Law contained in the Competition and Consumer Act 2010 (Cth) or the New Zealand Consumer Guarantees Act 1993 (CGA). You may be entitled to certain remedies (such as repair, replacement, or refund) if a Product fails to meet the consumer guarantees under these laws.
These rights apply in addition to any warranties we provide and cannot be excluded, restricted, or modified by contract.
DIAMOND GUARANTEE & JEWELLERY WARRANTY
All diamonds sold by us, whether natural or lab-grown, are guaranteed authentic and are accompanied by a certificate of authenticity. Where applicable, diamonds will also be provided with a third-party grading report.
All diamonds are sold with grading reports from recognised gemmological institutes. Grading assessments (e.g. cut, colour, clarity) are expert opinions and may vary slightly between certifying labs. Such variations do not constitute a defect.
We provide a 6-month limited warranty on our jewellery against manufacturing defects from the date of delivery. This warranty:
Covers defects in materials and workmanship;
Excludes damage from misuse, accidents, improper care, normal wear and tear, and unauthorised alterations or repairs.
You are responsible for the ongoing care and maintenance of your jewellery, including routine cleaning and inspections. Damage resulting from improper care, accidental impact, exposure to harsh chemicals, or lack of maintenance is not covered under warranty.
Any modification, resizing, or repair performed by a third party not authorised by us will void any warranty or return rights associated with the Product.

LIMITATION OF LIABILITY
(General Limitation); To the maximum extent permitted by law and subject to your rights under the Australian Consumer Law (ACL) and the New Zealand Consumer Guarantees Act 1993 (CGA), our total liability for any claim relating to the supply of goods or services is limited to, at our discretion:
replacement or repair of the goods;
the cost of having the goods repaired or replaced; or
the amount you paid for the goods.
We are not liable for any indirect, special, or consequential loss (including loss of profits, goodwill, or opportunity), or for any delay or failure caused by events beyond our reasonable control.
This clause does not limit your rights where we have failed to meet a consumer guarantee that cannot be excluded under the ACL or CGA, including your right to a refund, repair, or replacement in the case of faulty goods.
(Product Transit Claims): Claims for loss or damage to goods during delivery must be lodged with the courier. RoseCut will assist in facilitating claims, but is not liable for third-party shipping issues.
(Force Majeure): We are not liable for delays or failures caused by circumstances outside our control, including but not limited to natural disasters, pandemics, strikes, government actions, or courier disruptions.
EXCLUSIONS AND DISCLAIMERS
Except as required by the ACL or CGA or in accordance with clause 18.2:
All warranties not expressly set out in these terms are excluded.
RoseCut makes no guarantee that the Website or services will be uninterrupted, secure, or error-free.
All content, services, and products are provided “as is” and “as available,” without any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
EXCEPTIONS TO LIMITATIONS
The limitations and exclusions in this section do not apply to:
Fraud or intentional misconduct;
Death or personal injury caused by negligence;
Loss or damage to tangible property; or
Any other liability that cannot be excluded under the ACL or CGA.
GENERAL
DISPUTES
We are committed to resolving any concerns quickly and fairly. If you have a complaint or dispute relating to our Products or services, please contact us at [email protected] in the first instance. We will work with you in good faith to resolve the issue within a reasonable time.
If a dispute cannot be resolved informally, either party is entitled to pursue their legal rights and remedies in the usual course, subject to the governing law and jurisdiction set out in these Terms.
GOVERNING LAW AND JURISDICTION
This agreement is governed by the law applying in New Zealand. Each party irrevocably submits to the exclusive jurisdiction of the courts of New Zealand and courts of appeal from them in respect of any proceedings arising out of or in connection with these terms. Each party irrevocably waives any objection to the venue of any legal process on the basis that the process has been brought in an inconvenient forum.
WAIVER
No party to these terms may rely on the words or conduct of any other party as a waiver of any right unless the waiver is in writing and signed by the party granting the waiver.
SEVERANCE
Any term of these terms which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity and enforceability of the remainder of these terms is not limited or otherwise affected.
JOINT AND SEVERAL LIABILITY
An obligation or a liability assumed by, or a right conferred on, two or more persons binds or benefits them jointly and severally.
ASSIGNMENT
A party cannot assign, novate or otherwise transfer any of its rights or obligations under these terms without the prior written consent of the other party.
COSTS
Except as otherwise provided in these terms, each party must pay its own costs and expenses in connection with negotiating, preparing, executing and performing these terms.
ENTIRE AGREEMENT
This agreement embodies the entire agreement between the parties and supersedes any prior negotiation, conduct, arrangement, understanding or agreement, express or implied, in relation to the subject matter of these terms.
NOTICES
Any notices required to be sent under this agreement must be sent via email using the party’s email addresses set out in this agreement, and the email’s subject heading must refer to the name and date of this agreement.
If no email address is stated in this agreement, the notice may be sent to the email address most commonly used by the parties to correspond in relation to this agreement at the time the notice is sent.
The notice will be considered to be delivered 24 hours after it was sent, unless the sender has reason to believe the email failed to send or was otherwise not delivered or received.

RoseCut offers a range of fine jewellery including natural and lab-grown diamonds, engagement rings, earrings, bracelets, pendants and bespoke pieces. While we take care to ensure our product descriptions, pricing and imagery are accurate, we do not warrant that all information is error-free and reserve the right to correct any inaccuracies at any time without notice. While we strive to accurately represent our products, we cannot guarantee that the product images on our website will exactly match the final item you receive, especially regarding size, width, proportions, and appearance of the diamond. This includes differences in size relative to other elements (e.g., setting or thickness of the ring band) in the image. All images are rendered for the purpose of appeal and marketing.
Product images, digital renderings, and promotional materials shown on our website are intended to illustrate the general appearance, style, and design features of our jewellery, including diamond cut, clarity, and carat weight. These images may depict diamonds in a two-carat setting and are for marketing purposes only. Due to variations in lighting, screen & zoom settings, camera equipment, and rendering software, the actual appearance - including colour, size, and proportions - may differ from what is shown. Such differences do not constitute grounds for return. For accurate details, please refer to the individual product descriptions.
The product images provided on this website are for illustrative purposes only. As diamonds vary in cut, clarity, and carat weight, the actual diamond you receive may differ slightly in appearance from the image. These differences are inherent in the nature of the product, and any variations in the size or appearance of the diamond (based on your chosen carat weight) are not grounds for product returns or disputes.
All Lab-grown Solitaire diamonds will be certified by IGI (International Gemological Institute). All Natural Solitaire diamonds more than 0.30 carats will be certified by GIA (Gemological Institute of America).
All images and visual materials on our website are owned by RoseCut and protected by copyright. Use is permitted only for personal, non-commercial purposes related to evaluating a purchase.
Until the price of your Products is paid in full, title in those Products is retained by RoseCut. Risk in the Products will pass to you on delivery in accordance with clause 6. Delivery must not be refused by you.
All Products are subject to availability. If a Product is unavailable after you place an Order, we will contact you to offer a revised delivery estimate, an alternative Product, or a full refund.
CUSTOM ORDERS AND CONFIRMATIONS
By submitting or confirming a customised or bespoke order (including orders involving personalised design, diamond selection, resizing, engraving, or other modifications), you acknowledge and agree that:
The Product is being made specifically to your specifications;
Production may begin immediately upon confirmation;
Once confirmed, the order cannot be cancelled, changed, refunded, or exchanged once confirmed, except where required by law (such as for defective or faulty goods under the Australian Consumer Law or New Zealand Consumer Guarantees Act).
If you submit a request for a customised or bespoke design through our website, you are entitled to one free 30-minute consultation with our design team. This session allows us to discuss your preferences, clarify design requirements, and provide guidance on diamond and setting options. You may book your consultation via the online booking link provided after submitting your request. Consultations are subject to availability and are conducted via phone or video call, unless otherwise agreed.
PAYMENT
(Pricing): All prices are:
per unit (except where indicated);
in New Zealand Dollars (NZD) or Australian Dollars (AUD), depending on your selected region at checkout; and
subject to change prior to you completing an Order without notice.
(Payment obligations) Unless otherwise agreed in writing, you must pay for all Products at the time of placing an Order.
(GST & duties) For orders shipped to New Zealand, prices are inclusive of 15% GST, custom duties and insured shipping unless otherwise indicated. For orders shipped to Australia, prices are exclusive of GST, duties and any other fees/charges imposed by Australian authorities which are payable by the customer for any clearance at Australian customs. In relation to any GST payable for a taxable supply by RoseCut, you must pay the GST subject to RoseCut providing a tax invoice.
(Card surcharges) RoseCut reserves the right to charge credit card surcharges in the event that payments are made using a credit, debit or charge card (including Visa, MasterCard or American Express).
(Authorisation) By providing your payment details, you authorise us to charge the total amount of your order to the chosen payment method.
(Online payment partner) We may use third-party payment providers such as Stripe, GPay, Apple Pay and AfterPay (Payment Providers) to collect payments for Products. The processing of payments by the Payment Provider will be, in addition to these terms, subject to the terms, conditions and privacy policies of the Payment Providers accessible and, to the maximum extent permitted by law, we will not be liable for the security or performance of the Payment Providers. We reserve the right to correct, or to instruct our Payment Providers to correct, any errors or mistakes in collecting your payment.
(Pricing errors) In the event that we discover an error due to technical glitches or any other reason or inaccuracy in the price at which your order was purchased (including shipping prices), we will attempt to contact you and inform you of this as soon as possible. You will then have the option of purchasing your order at the correct price or cancelling your order. If you choose to cancel your order and payment has already been debited, the full amount will be credited back to your original method of payment.
DELIVERY AND SHIPPING
SHIPPING COSTS
(Shipping costs) Free Standard Shipping is included on all orders within New Zealand and Australia and are calculated upon checkout. All orders are shipped using insured courier services for your peace of mind.
(Processing & Delivery Times):
Standard Processing Time: Orders are typically processed within 4 to 5 weeks from the date of order, excluding public holidays;
Custom or Engraved Items: Processing may take longer. We will provide an estimated delivery timeframe when your order is confirmed;
Estimated Delivery: Once dispatched, orders typically arrive within 20–25 business days. Delivery times are indicative and may vary due to factors outside our control.
(Shipping Methods & Carriers): We use trusted courier partners, such as NZ Post & DHL, to ensure safe and secure delivery. Due to the high value of our products, a signature is required upon delivery.
(Tracking): Once your order is shipped, you will receive an email with tracking details. If you experience any issues with delivery or tracking, please contact us at [email protected]
(Delivery Locations & Restrictions): We currently ship only within New Zealand and Australia. We do not deliver to P.O Boxes or APO/FPO addresses. Please provide a valid physical address at checkout.
(Delivery Delays): While we do our best to meet delivery estimates, RoseCut is not liable for delays caused by: (i) Weather conditions; (ii) Courier delays; (iii) Customs processing; (iv) Natural disasters or unforeseen events. In the event of a significant delay, we will notify you with an updated delivery estimate.
(International Orders): At this time, international orders outside New Zealand and Australia are not accepted. If we approve an international order in special circumstances, you will be responsible for any customs duties, import taxes, and clearance fees. We are not liable for any such charges or delays related to customs.
(Lost or Damaged Packages):
Lost in Transit: If your package is lost, contact us immediately. We will liaise with the carrier to locate your parcel or provide a suitable resolution.
Damaged on Arrival: If your item arrives damaged, contact us within 24 hours of delivery at [email protected] with photos and a description. We will work with you to resolve the issue, which may include a replacement or refund.
(Address Accuracy): Please ensure your shipping address is complete and correct at the time of checkout. We are not responsible for delivery issues arising from incorrect or incomplete addresses. If you need to amend your address, contact us immediately. We will attempt to correct it before dispatch, but cannot guarantee changes once the order is in transit.
(Third-Party Courier Terms): Delivery is handled by third-party couriers, and their terms apply. While we will assist you in resolving any courier issues, we are not responsible for courier service failures beyond our control.

RETURNS AND REFUNDS
Change of Mind: We do not offer returns or refunds for change of mind, especially for bespoke or custom-made Products.
Return Eligibility for Pre-Designed Rings: You may return pre-designed (non-custom) Products within 30 days of dispatch, provided they are:
Unworn and in original, pristine condition; and
Accompanied by all original packaging, tags, and certification.
Non-Returnable Items: We do not accept returns on:
Bespoke or custom-made Products;
Products that have been worn, engraved, resized, or altered;
Products repaired or modified by unauthorised third parties
RING RESIZING
(Eligibility for Resizing): Most standard rings are eligible for one complimentary resizing, subject to inspection. Customised, bespoke, or engraved rings are not eligible for resizing unless agreed in writing before purchase. Resizing is typically available within two sizes up or down. Resizing beyond this range sometimes may not be possible and may incur additional charges.
(Resizing Requests): Resizing requests must be made within 30 days of delivery. To request a resize, email [email protected] with your order number and new ring size. Any applicable fees will be confirmed before we proceed.
(Resizing Process & Timeframe): Processing time for resizing is typically 10–15 business days, but may vary depending on ring design and material. Customers are responsible for shipping costs to and from our resizing facility. We recommend using tracked and insured shipping.
(Limitations & Risk): Some designs (such as intricate settings or pavé bands) may not be suitable for resizing. If resizing is not feasible, we will notify you. Resizing is carried out by a third-party jeweller. While all care is taken, RoseCut is not liable for damage to settings, stones, or structural integrity during the resizing process.
(Refunds & Exchanges for Resized Items): Resized rings are not eligible for refund or exchange under our returns policy. If resizing is not possible, no exchange will be offered unless otherwise required under consumer law.
(Customer Responsibility): It is your responsibility to provide the correct ring size. We recommend visiting a local jeweller or using a sizing tool prior to purchase. RoseCut is not responsible for resizing requests based on incorrect size information provided by you.
RETURN PROCESS

Package Securely: Include all original documentation and certificates.
Use Tracked Courier: Ship via a tracked, insured courier. The return cost and risk remain with you.
Inspection: Your return will be assessed by our quality control team (up to 20 business days). If accepted, your refund will be processed within 10–15 business days to your original payment method.
FAULTY OR DAMAGED ITEMS
If your order arrives damaged or faulty:

If we determine the Product may be faulty, you’ll be asked to return it (including original documentation) for further assessment.
If the Product is confirmed faulty, you’ll be offered a refund, store credit, or replacement, including return shipping costs.

Failure to follow care instructions.
If the fault is not confirmed after assessment, the Product will be returned to you at your expense.

In this clause 7, “intellectual property rights” means all copyright, trade mark, design, patent, semiconductor and circuit layout rights, trade, business, company and domain names, confidential and other proprietary rights, and any other rights to registration of such rights whether created before or after the date of these terms both in New Zealand, Australia and throughout the world.
THIRD PARTY TERMS SUPPLIERS
If we need to acquire goods or services supplied by a third party, you may be subject to the terms and conditions of that third party (Third Party Terms).

CONSUMER LAW PROTECTIONS
Nothing in these Terms limits your rights under the Australian Consumer Law contained in the Competition and Consumer Act 2010 (Cth) or the New Zealand Consumer Guarantees Act 1993 (CGA). You may be entitled to certain remedies (such as repair, replacement, or refund) if a Product fails to meet the consumer guarantees under these laws.
These rights apply in addition to any warranties we provide and cannot be excluded, restricted, or modified by contract.
DIAMOND GUARANTEE & JEWELLERY WARRANTY
All diamonds sold by us, whether natural or lab-grown, are guaranteed authentic and are accompanied by a certificate of authenticity. Where applicable, diamonds will also be provided with a third-party grading report.
All diamonds are sold with grading reports from recognised gemmological institutes. Grading assessments (e.g. cut, colour, clarity) are expert opinions and may vary slightly between certifying labs. Such variations do not constitute a defect.
We provide a 6-month limited warranty on our jewellery against manufacturing defects from the date of delivery. This warranty:
Covers defects in materials and workmanship;
Excludes damage from misuse, accidents, improper care, normal wear and tear, and unauthorised alterations or repairs.
You are responsible for the ongoing care and maintenance of your jewellery, including routine cleaning and inspections. Damage resulting from improper care, accidental impact, exposure to harsh chemicals, or lack of maintenance is not covered under warranty.
Any modification, resizing, or repair performed by a third party not authorised by us will void any warranty or return rights associated with the Product.

LIMITATION OF LIABILITY
(General Limitation); To the maximum extent permitted by law and subject to your rights under the Australian Consumer Law (ACL) and the New Zealand Consumer Guarantees Act 1993 (CGA), our total liability for any claim relating to the supply of goods or services is limited to, at our discretion:
replacement or repair of the goods;
the cost of having the goods repaired or replaced; or
the amount you paid for the goods.

(Product Transit Claims): Claims for loss or damage to goods during delivery must be lodged with the courier. RoseCut will assist in facilitating claims, but is not liable for third-party shipping issues.
(Force Majeure): We are not liable for delays or failures caused by circumstances outside our control, including but not limited to natural disasters, pandemics, strikes, government actions, or courier disruptions.
